The entitlement, and the confusion around it

Statutory leave is 5.6 weeks a year. For someone working five days a week that is 28 days, and an employer may count bank holidays within it rather than on top of it — which is where most disagreements start.

Part-time workers get the same 5.6 weeks pro rata. Workers with irregular hours accrue leave as they work, and the rules here changed recently enough that older guidance is unreliable.

What tracking has to handle

  • Entitlement per employee, pro rata for part-time and mid-year starters.
  • Accrual for irregular hours and casual staff.
  • Requests, approvals and a visible team calendar so cover is obvious.
  • Carry-over rules, including the limited cases where untaken leave must carry.
  • Sickness recorded separately, because it interacts with leave.
  • Final pay calculations, where untaken leave is paid on leaving.

Do bank holidays count towards the 28 days?

They can. An employer may include them within the 5.6 weeks or grant them on top. What matters is that the contract says which, clearly.

How does holiday work for zero-hours staff?

Leave accrues based on hours worked. The rules for irregular-hours and part-year workers have changed in recent years, so check the current position rather than relying on older guidance.

What happens to untaken leave when someone leaves?

Accrued but untaken statutory leave is paid in the final payslip. Getting this wrong is a common source of disputes at exactly the point goodwill is lowest.

Can staff request leave themselves?

Yes. Logins are unlimited, so an employee can see their balance and put in a request, and you approve it from the same place — which ends the version where approvals live in a text thread nobody can find.
